1. Data Controller

Advocaat Uithoorn, with its registered office at Amsterdamseweg 34, 1422 AD Uithoorn, is responsible for the processing of personal data in connection with its legal services. Questions may be submitted to kantoor@advocaatuithoorn.nl.

2. What personal data do we process?

We process personal data that you provide to us, such as your name, address, place of residence, email address, telephone number, date of birth, bank account number, identification details and information required for the handling of your case.
Depending on the nature of the case, special categories of personal data or other sensitive information may also be processed, such as financial, employment, health, criminal or family and living-situation data, insofar as this is necessary for the handling of the case.
In the case of business clients, we also process data relating to contact persons, directors, representatives, UBOs and other persons involved in the matter.

3. What do we use personal data for?

We process personal data for the assessment and acceptance of instructions, the performance of the engagement agreement, communication with clients and third parties, invoicing and administration, compliance with legal obligations, conflict-of-interest checks, identification, anti-money laundering checks where applicable, archiving and complaint handling.

4. Legal bases

Personal data is processed where this is necessary for the performance of an agreement, compliance with legal obligations, the protection of the legitimate interests of the firm or the client, the establishment, exercise or substantiation of legal claims and, where necessary, on the basis of consent.

5. Sharing data

We share personal data only insofar as this is necessary for the handling of the case or to comply with legal obligations. This may include courts, bailiffs, opposing parties, lawyers, experts, the Dutch Legal Aid Board, accountants, IT service providers, hosting and software providers, and supervisory authorities.
Where necessary, we enter into a data processing agreement with processors that process personal data on our behalf.

6. Communication channels

Communication will generally take place by email, telephone or post. WhatsApp and other accessible communication channels are used only for short practical messages and not for confidential case documents or substantive legal advice, unless expressly agreed otherwise.

7. AI and personal data

Advocaat Uithoorn uses AI solely as a supporting tool. Personal data, client information and case-related information are not entered into public or general-purpose AI systems. AI is used only with general or fully anonymised information, and the lawyer remains responsible at all times for reviewing the output.

8. Security

We take appropriate technical and organisational measures to protect personal data against loss, unauthorised access and unlawful processing. These measures include confidentiality obligations, restricted access, secure digital storage, passwords, antivirus and security software, backups, and periodic reviews of security measures.

9. Retention periods

Case files are generally retained for at least five years after closure, unless a longer retention period is necessary due to the nature of the case, liability risks, legal obligations or legitimate interests. Financial data is retained for at least seven years.
After the retention period has expired, data will be deleted or destroyed, unless further retention is necessary or required by law.

10. Your rights

Subject to the limits set by the GDPR and the lawyer’s duty of confidentiality, you have the right to request access to, rectification or erasure of your personal data, restriction of processing, data portability and to object to processing. Requests may be submitted to mdewit@advocaatuithoorn.nl.
If you are dissatisfied with the way in which your request has been handled, you may lodge a complaint with the Dutch Data Protection Authority.

11. Amendments

This privacy statement may be amended if legislation, case law, technology or internal office processes change. The most recent version is available from the firm and, where published, via the website.
